Fiona practises nationally as a barrister, arbitrator and mediator in relation to disputes involving technology, engineering and construction; transport, aviation and maritime law; general commercial law and insolvency; and Federal and State taxation and revenue.

 

She has been recommended in Doyle’s Guides to Leading Construction and Infrastructure Junior Counsel, and to Leading Commercial Litigation and Dispute Resolution Junior Counsel, as well as in Legal500.

 

Fiona is a Fellow of the Chartered Institute of Arbitrators, a member of the Arbitrators’ and Mediators’ Institute of New Zealand and a Grade 3 Arbitrator (Resolution Institute). She is a nationally accredited mediator under the Australian Mediator and Dispute Resolution Accreditation Standards (AMDRAS).

 

Fiona is a member of Young’s List Barristers in Melbourne, and a visiting member of William Forster Chambers in Darwin.

Fiona has experience appearing in superior courts across Australia, the Federal Court of Australia, and in the High Court of Australia, as well as before commissions of inquiry and administrative and arbitral tribunals. Some examples of Fiona’s recent cases include disputes relating to:

 

  • Large scale construction and infrastructure projects, such as the design and construction of bridges, tunnels and other major developments
  • Commercial disputes, including in relation to franchising arrangements, sales of businesses and shareholdings, operation of public assets and services, and general contractual breaches
  • Corporations and insolvency matters, including allegations of oppressive conduct, breaches of directors’ duties and voidable transactions
  • Energy, mining and resources projects, such as in relation to LNG facilities, renewables projects including wind turbine generators and solar farms, mining tenements and joint venture arrangements, land fill operations and electricity infrastructure, and
  • Technology and product liability matters, such as in relation to the suitability and manufacturing quality of components for a public emergency address system in a large tunnel project, and a dispute concerning the design of a private passenger jet.

Before joining the Independent Bar in 2015, Fiona was Associate to the Honourable Justice Pagone of the Federal Court of Australia. Prior to this, Fiona was Associate to the Honourable Justice Davies and the Honourable Justice Hargrave of the Supreme Court of Victoria, where she assisted in matters in the commercial trial division and in criminal and civil appeals. Fiona was previously employed by boutique commercial and construction law firm Crawford Legal.
